Interested parties are hereby notified that the U.S. Army Corps of Engineers, Portland District (USACE) is seeking public comment on the Hammond Small Boat Basin Disposal Environmental Assessment (EA) and draft Finding of No Significant Impact (FONSI), Clatsop County, Oregon.  The EA and draft FONSI was prepared in accordance with the National Environmental Policy Act (NEPA), the Council on Environmental Quality’s NEPA regulations (40 C.F.R. parts 1500-1508), and the Corps’ NEPA regulations (33 C.F.R. part 230).  


USACE is proposing to convey by quitclaim deed the Hammond Small Boat Basin (Basin) to the City of Warrenton (City), located in Clatsop County, Oregon.  The need for the proposed action is to comply with Sections 6005(d) and (g) of Water Resources Reform and Development Act of 2014 (WRRDA 2014).
USACE was directed by Congress to convey the Hammond Boat Basin to the City of Warrenton without any compensation, monetary or in-kind.  Additionally, implementation guidance clarifies the terms and conditions of the conveyance as provided in WRRDA 2014. These terms and conditions are summarized below: 

  • The City shall assume full responsibility for operating and maintaining the channel and the breakwater.
  • If the Army determines that the land conveyed ceases to be owned by a public entity, all right, title, and interest in and to the land shall revert, at the discretion of the Army, to the United States. A revisionary clause will be included in the deed and will reflect state law.  
  • After the land is conveyed, the land shall no longer be a portion of the Hammond Small Boat Basin project for navigation as authorized by section 107 of the Rivers and Harbor Act of 1960 (33 U.S.C. § 577)

 

Assessment of the Need for an Environmental Impact Statement: USACE has preliminarily determined the proposed action is not likely to result in significant effects on the human environment, and therefore an environmental impact statement (EIS) will not be prepared. The draft FONSI is included with the EA for public review.

Public Comment Period: The EA and FONSI will be available for public comment for 15-days after the date of this public notice. The public comment period is intended to provide those interested in or affected by this action an opportunity to make their concerns or comments known. USACE will consider comments received during the 15-day comment period in making a determination on a finding of no significant impact.
