NWP-2020-00383 and 408-0109-FY 22 Availability of Draft EIS

To Whom It May Concern: The U.S. Army Corps of Engineers (USACE), Portland District, is evaluating an application for a Department of the Army permit (No. NWP-2020-00383), and a potential Section 408 permission (No. 408-0109-FY22), for the proposed NEXT Renewable Fuels Oregon project. USACE as the lead federal agency under the National Environmental Policy Act (NEPA), has prepared a Draft Environmental Impact Statement (DEIS) for the proposed project. The DEIS assesses the reasonably foreseeable impacts of the NEXT Renewable Fuels Oregon project on several resources including those stated below. In addition, NEPA requires that an EIS include a reasonable range of alternatives that are technically and economically feasible and meet the purpose and need of a proposal. Alternatives may include on-site design modifications or off-site locations. Alternatives carried forward for this analysis are detailed in the DEIS.

The DEIS is available for review on the USACE Portland District website at https://www.nwp.usace.army.mil/Missions/Regulatory/NEXT-Renewable-Fuels-EIS/. USACE projects that a Notice of Availability for the DEIS will be posted in the Federal Register on February 27, 2026. At that time, the DEIS will be available for review at https://www.epa.gov/nepa. The required 45-day comment period for the DEIS will commence once the Notice of Availability is published in the Federal Register.
