Interested parties are hereby notified that an application has been received for a Department of the Army permit for certain work in waters of the United States, as described below and shown on the attached plan.

Location:        The project is located on Interstate 5 across the Columbia River, between the cities of Portland, Oregon and Vancouver, Washington (Center coordinates Lat/Long: 45.6167, -122.6750).

 

Waterway: Columbia River, River Mile 106.5

Project Description:  The US Federal Highways Administration and the US Federal Transit Administration are the lead federal agencies for the Interstate 5 Columbia River Crossing between Vancouver, Wash., and Portland, Ore. The Corps accepted cooperating agency status on May 6, 2009. The project will be jointly implemented by the Washington Dept. of Transportation and the Oregon Dept. of Transportation.

 

As a part of a five-mile transportation improvement project, the Departments of Transportation from Oregon and Washington are requesting Department of the Army authorization for work related to the replacement and new construction of Interstate Highway 5 infrastructure affecting the Columbia River and the North Portland Harbor. The project involves the discharge of 60,408 cubic yards of fill, temporarily impacting 0.9477 acre and the discharge of 50,486 cubic yards of fill permanently impacting 1.6204 acres of waters of the U.S. The existing northbound and southbound bridges over the mainstem Columbia River will be replaced and up to four new auxiliary bridges may be constructed over North Portland Harbor. The project described herein is approximate and contingent upon awarding to contractors for design and building. Should the awarded contractor request changes that would require an increase or significant change in the scope of impacts evaluated, a new Public Notice may be issued.

 

MAINSTEM COLUMBIA RIVER CROSSING

 

For the mainstem Columbia River crossing, two dual-level replacement bridges will be constructed downstream of the existing bridges. Each bridge will accommodate three flow-through lanes, two auxiliary lanes for nearby interchanges, and full safety shoulders on the top deck. The sub levels will accommodate light rail on one bridge and both bicycle and pedestrian traffic on the other. The new bridges will be supported on six in-water pier complexes, each with six 10-foot diameter drilled shafts bound by a shaft cap for a total of 12 shaft caps and 72 in-water drilled shafts.   

 

Work bridges and temporary work platforms will be constructed to allow equipment to access Pier complexes 2 and 7 nearest to the shoreline. The piers at complexes 2 and 7 will be isolated using sheet-pile cofferdams driven with vibratory hammer. For all bridge foundation construction drilled shafts will be installed in pre-bored steel casings advanced using a vibratory hammer, oscillator or rotator. Drilling will extend to 10 feet into the Troutdale Formation, a geologic feature located approximately 200 feet below the bed of the Columbia River. Displaced drill waste, slurry, and water will be pumped out for appropriate upland disposal during drilling and as concrete is poured into the bore holes. Shaft caps at these locations will be poured concrete in sealed forms to prevent contact with flowing waters. Once the pier complexes are completed, the sheet pile will be removed using vibratory hammer or direct pull method. Cofferdams will be dismantled prior to construction of the support columns and superstructure.

 

Pier complexes 3 through 6 will be constructed by barges, work platforms and work bridges. Construction of pier complexes 2 through 7 will require placement of 1,161 piles for work platforms, work bridges, mooring and other temporary structures. Each platform will require approximately 25 to 30 days to construct and will be in place approximately 130 to 300 work days. Barge moorings may remain in place approximately 120 days at any given location. Piling will be installed using vibratory hammer. To minimize potential damage to aquatic species by high pressure hydroacoustic waves, load-bearing piling will first be driven to refusal with a vibratory hammer before proofed with an impact hammer. Once temporary structures are in place, drilled shafts will be installed as described for pier complexes 2 and 7. Shaft caps will be pre-cast concrete, each measuring 115 feet long by 45 feet wide by 16 feet tall. Each shaft cap will extend from 5.28-feet North American Vertical Datum 88 to approximately 21.2-feet NAVD88. The shaft caps will placed by crane and fixed to the 6 drilled shafts at each pier complex.

 

After pier complexes are completed, the temporary structures will be removed to make room for cranes, work barges, and material barges needed to build the columns and superstructure. Generally, no more than 12 barges will be moored or moving in the bridge vicinity at a time to minimize disruption to navigation. During construction, at least one main navigation channel will be open at all times to the extent feasible.

 

NORTH PORTLAND HARBOR CROSSINGS

 

Three new bridges are also proposed for construction across North Portland Harbor, consisting of a light rail bridge, a northbound on-ramp bridge from Marine Drive to Interstate 5 North, and a southbound off-ramp bridge from Interstate 5 to Marine Drive. A fourth bridge connecting Hayden Island to Interstate 5 may be proposed at a later date based on future funding. The temporary structures including work bridges, oscillator support platforms, and support towers will require 1,278 piles measuring two-foot diameter. It is estimated only 300-800 pilings will be placed in the river at any given time. All piling will be installed using vibratory hammer while load bearing pile will be additionally proofed with an impact hammer. House boats, supporting infrastructure, and other obstacles to construction will be removed and relocated to appropriate locations or demolished at appropriate disposal facilities depending on specific arrangements between the project proponents with owners and stakeholders.

 

The existing bridge across North Portland Harbor will be retrofitted for improved seismic safety. The bridge will be re-purposed to accommodate three flow-through lanes and two auxiliary lanes for southbound traffic, and three flow-through lanes and one auxiliary lane for northbound traffic.

 

The northbound and southbound ramp bridges will each be composed of four in-water piers with two 10-foot diameter shafts per pier for a total of 16 drilled shafts. The piers will be aligned with Bents 4 through 7 of the existing bridge. The superstructures will be placed on pre-cast concrete or steel plate girders, requiring work bridges and cranes. The ramp bridges will be constructed immediately upstream and downstream from the existing bridge.

 

A new light rail bridge will require four in-water piers with three 10-foot diameter drilled shafts per pier for a total of 12 drilled shafts. The piers will be aligned with Bents 2 through 6 of the existing bridge. The superstructure will be placed on pre-cast concrete or steel plate girders, requiring work bridges and cranes. The bridge will be constructed west of the existing bridge and the southbound off-ramp bridge.

 

GENERAL

 

Once construction is completed sufficiently for traffic operation, the existing bridges across the Columbia River will be demolished. The current bridges are supported on 11 piers with nine located below ordinary high water. Bridge piers are composed of driven timber pile and concrete. Piers will be cut into manageable chunks and transported offsite. Timber piles exposed above the riverbed will be extracted or cut below mudline. Demolition debris will be loaded and transported to appropriate facilities by barge. If temporary piling or cofferdams are required, installation and removal methods will be similar to those described above.

 

Before final design, an additional six geotechnical boring events will be conducted. Exploratory work will require barge mounted drilling to a depth of approximately 50 feet into the Troutdale Formation. Borings are estimated to be by a four- to five-inch diameter drill bit through a five-inch steel casing. After information and samples are collected, bore holes will be backfilled with bentonite grout.

 

Three areas are identified as staging for materials and equipment. These areas are not expected to require new or additional infrastructure; however, if construction or in-water work is required by the contractor to utilize these areas, the Corps will determine if a permit re-evaluation and public notice would need to be initiated.

 

The project activities over North Portland Harbor have the potential to affect federally constructed levees designed to reduce flood damage from extreme high flow events. The activities over the mainstem Columbia River may also affect the federal navigation channel and the Corps’ ability to maintain the channel both upstream and downstream from the bridge location. 

 

The Corps will evaluate potential impacts to aquatic resources resulting  from the discharge of dredge or fill material associated with the construction, operation, or maintenance of Coast Guard approved bridges across navigable waters of the U.S.  The Corps will also evaluate potential impacts to federally authorized projects including the ability for the Corps to maintain the federal navigation channel or respond in a flood fighting capacity.  The Corps will work with the applicants through the course of our evaluations to ensure all information needs and substantive issues are sufficiently addressed.

 

Mitigation: The applicant has provided a compensatory mitigation plan for the enhancement and improvement of shallow water refuge, spawning, and rearing habitat for migratory aquatic species.  Habitat enhancement efforts will take place in both Washington and Oregon states. If a permit is issued, the Corps will determine what is appropriate and practicable compensatory mitigation.  The amount of compensatory mitigation required shall be commensurate with the anticipated impacts of the project.  Mitigation plan details can be obtained upon request to Mr. Dominic Yballe at the above address.

Purpose:  The purpose of the project is to improve safety and vulnerability issues, improve commercial and general traffic mobility, and provide multimodal transit options between Vancouver, Wash., and Portland, Ore.

Authority:  This permit will be issued or denied under the following:

 

        Section 404, Clean Water Act of 1972 (33 U.S.C. 1344), for discharge of dredged or fill material into waters of the United States.  Activities subject to this authority include discharges that change the bottom elevation of waters of the U.S. including but not limited to concrete poured into sealed forms, sand bag cofferdams, and approach fills in wetlands or below the ordinary highwater mark of water courses.

 

        Section 10, Rivers and Harbors Act of 1899 (33 U.S.C 403), for activities that may affect the course capacity, condition, or location of navigable waters of the U.S.  Activities subject to this authority include but are not limited to relocation or removal of in-water structures such as houseboats or supporting infrastructure.  Activities related to construction, operation, or maintenance of bridges or causeways in Navigable waterways is subject to separate authority by the U.S. Coast Guard.  Fill associated with these activities may be captured under Section 404 of the Clean Water Act.

 

        Section 14, Rivers and Harbors Act of 1899 (33 U.S.C. 408) Taking possession of, use of, or injury to harbor or river improvements.  Activities subject to this authority include those actions that would modify or affect the intended uses of federally authorized levees, navigation channels, or other federal projects.

 

Water Quality Certification:  A permit for the described work will not be issued until certification, as required under Section 401 of the Clean Water Act (P.L. 95‑217), has been received or is waived from the certifying states. 

 

Section 404(b)(1) Evaluation:  The impact of the activity on the public interest will be evaluated in accordance with the Environmental Protection Agency guidelines pursuant to Section 404(b)(1) of the Clean Water Act.

 

Public Hearing:  Any person may request in writing within the comment period specified in this notice that a public hearing be held to consider this application.  Requests for public hearings shall state with particularity the reasons for holding a public hearing.

 

Endangered Species:  Preliminary determinations indicate that the described activity may affect an endangered or threatened species or its critical habitat.  The National Marine Fisheries Service issued a biological opinion to FHWA and FTA on January 18, 2011 for impacts to migratory aquatic species including sturgeon, salmon, steelhead, eulachon, and marine mammals.  In a letter dated August 27, 2010, the US Fish and Wildlife Service indicated concurrence with FHWA and FTA that the project would not adversely affect Bull Trout.

 

Cultural Resources:  This notice has been provided to the State Historic Preservation Office, interested Native American Indian tribes, and other interested parties.  If you have information pertaining to cultural resources within the permit area, please provide this information to the Corps project manager (identified above in this notice) to assist in a complete evaluation of potential effects.

 

The Corps entered into a Memorandum of Agreement on September 8, 2011 with the FHWA, FTA, the Washington Department of Historic Preservation, the Oregon State Historic Preservation Office, and with interested tribes. The Memorandum details the undertakings to be implemented in a manner that would minimize potential adverse impacts to known and undiscovered resources of concern. 

Navigation:  The project may affect navigation both temporarily and permanently.  Issues such as bridge height and obstruction to navigation are considered by the Coast Guard under their authority under the General Bridge Act of 1946 and other related laws. The Corps will coordinate and provide comments to the Coast Guard through their evaluation of a bridge permit. The Corps will not authorize impacts that result in unacceptable impacts to navigation or that would preclude the Corps’ ability to maintain federally authorized projects.

Flood Risk:  The North Portland Harbor crossings will affect federally authorized levees constructed for flood risk reduction. The Corps will assess potential impacts to flood protection and flood fighting capability. The Corps cannot authorize impacts that would reduce the protection provided by the federally authorized levees without Congressional re-authorization or de-authorization of the levees.  The Corps will coordinate with the Multnomah County Drainage District for any potential affects to their ability to maintain the levees or to respond to flood risk events.

Evaluation:  The decision to issue a permit will be based on an evaluation of probable impacts including cumulative impacts of the described activity on the public interest.  That decision will reflect the national concern for both protection and utilization of important resources.  The benefit, which reasonably may be expected to accrue from the described activity, must be balanced against its reasonably foreseeable detriments.  All factors, which may be relevant to the described activity will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and, in general, the needs and welfare of the people.

 

The Corps is soliciting comments from the public; Federal, state, and local agencies and officials; Indian tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity.  Any comments received will be considered by the Corps to determine whether to issue, modify, condition or deny a permit for this proposal.  To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above.  Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act.  Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity.

 

Additional Requirements:  State law requires that leases, easements, or permits be obtained for certain works or activity in the described waters.  These requirements must be met where applicable, and a Department of the Army permit must be obtained before any work within the applicable Statutory Authority previously indicated may be accomplished.  Other local governmental agencies may also have ordinances or requirements, which must be satisfied before the work is accomplished.
